THE PROCESS OF FORMING A SINGLE EUROPEAN LEGISLATION IN THE FIELD OF REGULATION OF MIGRATION PROCESSES

Abstract

Article is written on actual topic connected with formation of the common migration policy of the European Union and improvement of the European legislation in the sphere of regulation of migratory processes. The analysis which is carried out in article reflects the profound changes which happened in the legislation of the European Union at a turn of the XX-XXI centuries in the field of migration policy. Activities of institutes of the European Union for development and realization of effective migration policy promoted standardization in the field of visas, transit documents, and also residence permits. Thanks to acceptance of a number of acts at the level of the EU, questions of migration policy and its realization partially moved to supranational level. In article the importance of the Schengen agreements on the way of creation of uniform European space and harmonization of visa policy within the EU is emphasized. The unification of a visa format realized within the Maastricht Treaty increased ability of the Union to control migration flows, and citizens of the third countries found the right to move across the Union territory, with the uniform visa. Prerequisites of acceptance and further work of institutes of the EU on implementation of the Amsterdam Treaty which fixed new approach to conducting common migration policy by member countries are considered. According to authors, the work format in intergovernmental groups was quite effective in respect of understanding and a formulation of the main problems of regulation of migration flows within the EU.
