THE POSITION AND ROLE OF THE AUTHORITIES FOR THE SOCIAL AND LEGAL PROTECTION OF CHILDREN IN THE CZECH REPUBLIC

Abstract

The Czech Republic, as a signatory of the Convention on the Rights of the Child has vested the capacity to administer the state protection of minor children into the agenda of the general municipal offices of the municipalities of higher order. The protection of the rights and entitlements of minor children s conducted by the authorities of social and legal protection of children (ASLPC hereinafter). These authorities are incorporated in the system of state administration in a way which enables them to provide complex care for minor children in the extent guaranteed by the Act No 359/1999 Coll., Act on the Social and Legal Protection of Children, as amended. The Czech Republic has significantly amended the area of social and legal protection of children. The rights of minor children have been significantly strengthened and new means for their protection have been established. New legal treatment of family law has been adopted. Family law is now incorporated in the Act No 89/2012 Coll., the Civil Code. Additionally, corresponding procedural acts have been adopted to further support and incorporate these changes. It is equally important to legally base the position of the people employed in the authorities and to regulate the necessary requirements for their specialist knowledge and education. Their job positions are extremely demanding and the employees are expected to carry out work duties to their best knowledge. We have carried out the analysis of the legal regulation thereof in its historical context and with respect to its applicability and the powers of the ASLPC. We have defined the lacking and gaps in the legal regulation and assessed the possibilities of the further development of the organization and realization of the social and legal protection of children in the Czech Republic.
