AVOIDING THE INTERNATIONAL LAW IN BORDER DEMARCATION

Abstract

Border delimitation processes in the past decade have been characterized by involvement of interdisciplinary professionals such as: Legal experts, land surveyors, geographers, political scientists, historians, security experts, along with border practitioners engaged in the real aspects of border demarcation, delimitation and management. Frontier disputes caused various challenges to new countries of former SFR Yugoslavia. This article provides an overview of the dispute and debates on border demarcation process between Kosovo and Montenegro, as countries derived by the fall of Yugoslavia. The main focus of this article is to describe the process and challenges of the border demarcation, specifically the case between Kosovo and Montenegro, which has begun in 2012. The importance of maps of various scale and purpose, as well as the principles of the International Law, and many other examples are treated consistently. Nowadays, there are a lot of reference points for the treatment and execution of border demarcation worldwide, specifically in ex-Yugoslavia. For this region, in general, the main border delimitation principles are given by Badinter commission [9], whereas for Kosovo as supplement, it is presented in the Ahtisaari plan for Kosovo [1]. These contributions and recommendations seem to be insufficient to resolve all disputes in the definition of the right border line between these countries. This article aims to offer a respective approach in the terms of the source data and methodology to be used for an acceptable version of the border line demarcation between two countries specifically and with further adoption in wide terms of use.
