MURDER CIRCUMSTANCES IN ROMANIAN CRIMINAL LAW (I). PREMEDITATION, MATERIAL INTEREST
Abstract
Through this study we want to highlight the Romanian legislation regarding murder and the circumstances that make the crime of murder severely punished. I analyzed only two circumstances of eight, premeditation and material interest. Each of these circumstances could be taken if specific conditions are met. There are also controversial situations in Romanian literature and jurisprudence regarding the detention of premeditation, situations which are to be analyzed in the paper and submitted to discussions to those interested. This paper will attempt to answer the following questions: Is there compatibility or incompatibility between premeditation and incitement? What is the connection between incitement, revenge and premeditation? Is the material interest the aim or the means of the murder? The work will be continued with the following aggravating circumstances of the murder, in order to create a full picture of the crime of murder in Romanian law.
