LEGAL AND ORGANIZATIONAL PROBLEMS OF INTERNATIONAL COOPERATION IN THE FIELD OF COUNTERACTING ABDUCTION OF PEOPLE, TRAFFICKING IN PEOPLE AND THE USE OF THEIR SLAVE LABOR

Abstract

The economic and political instability in many countries, the growth of unemployment, the decline in social security and the intensification of migration processes have formed trends in the spread of kidnapping, human trafficking, the use of their slave labor and other crimes aimed at personal freedom. The organized, international and transnational nature of these crimes, as well as their spread in many states, predetermined the need for cooperation between law enforcement agencies of various countries in the field of international justice to counter these negative phenomena. This problem served as the basis for the formation of the subject of this study, which were the laws of international cooperation in the field of combating crimes aimed at personal freedom. The purpose of this article is to develop scientifically based recommendations to law enforcement agencies of various states on the organization of counteraction to kidnapping, human trafficking, the use of their slave labor in the field of international justice. The authors analyze the most relevant legal forms of interaction between Russian law enforcement agencies and competent officials of foreign countries: they consider the features of sending requests for legal assistance in criminal matters, as well as the specifics of extradition of persons located in the territory of a foreign state for criminal prosecution or for the execution of a sentence in the territory another state. The practice of the interaction of law enforcement agencies of different states is examined and the differences in the legal regulation of certain social phenomena, such as prostitution, the customs of bride kidnapping, the criminalization of individual attacks on personal freedom, and others, are investigated. The author argues the existing organizational, institutional, legal and other problems of the investigated forms of cooperation, and also suggests ways to optimize the system of counteraction to these negative phenomena. In the process of the study, the authors used legal, sociological and other methods of scientific knowledge. The authors relied on the materials of 430 investigated criminal cases on violations of personal freedom, the results of interviews with 320 law enforcement officers, scientific developments of other researchers on the issue under consideration, as well as statistical data.
