PROBLEMS OF CORRELATION BETWEEN INTERNATIONAL HUMANITARIAN LAW AND INTERNATIONAL HUMAN RIGHTS LAW
Abstract
The article is devoted to the problems of correlation between International Humanitari-an Law and International Human Rights Law, mainly to investigation of two viewpoints on the issue. International Humanitarian Law and International Human Rights Law are by themselves two different but mutually complementary branches of International Pub-lic Law. Both are aimed at ensuring protection life, health and human dignity. Whereas International Humanitarian Law is implemented solely in situations of armed conflicts, International Human Rights Law, in accordance with the generally adopted approach, continues to be applied both at peace and war times. The study of correlation reveals a number of still existing problems and obstacles cropped up from their mutual imple-mentation. The author also researches the problem of applicability of International Hu-man Rights Law in combination with International Humanitarian Law under conditions of an armed conflict; complications affecting definitions of correlation between the In-ternational Humanitarian Law and the International Human Rights Law at non-international armed conflicts time. Mandate of law-protecting organizations is another important research problem of the article. The author uses the common methodological approaches for investigation such as method of description, method of conceptual anal-ysis, method of evaluation.
