DOMESTIC SPACE LAW – POLISH PROPOSALS
Abstract
Despite PolandВ’s ratification of all major international space law treaties, except the 1979 moon treaty, it has not implemented these norms in internal legal order. It is therefore quite difficult to discuss unlegislated national space law. The only domestic reference to space law is the Act establishing the Polish Space Agency and Polish Space Strategy, but this Act is not legislative. Although Poland has many obligations resulting from membership in the European Union (since 2004) and the European Space Agency (since 2012), there is still no unified legal act which regulates PolandВ’s activity in outer space by defining the concepts, principles, goals and purposes of space activities. This author considers that PolandВ’s current stage of implementing space law legislation can draw patterns from other statesВ’ space-activity Acts, because these have a much longer tradition. The present moment is most opportune for Polish legislators to approach this important issue with great consideration; not only from the viewpoint of international obligations but also because of the considerable importance of appropriate legislation for the Polish space sector, science and business.
