REFORM IN JUSTICE AS A CONDITION FOR THE DEMOCRATIZATION OF REPUBLIC OF MACEDONIA AND EURO-ATLANTIC INTERGRATIONS
Abstract
Division of power as a base principle of construction of state power is a major precondition for establishment and construction of democratic and functional states in accordance with international acquitted standards and practices. The last political and institutional crisis in RM reveals serious flaws in functioning of justice system, as corruption, politization, scope of judicial institutions from politics, etc., but above all the loss of citizensВ’ faith. The rule of law, democracy and respect for human rights are the basic values of democratic state and precondition for European integrations of every country. Judicial power must be independent and unbiased and in accordance with international standards and not serve as an instrument to protect the politics of power and business structures and politics related to power holders. Institutions of the judiciary from international organizations were evaluated as captured institutions and as such they violate citizens' rights in court proceedings but also in the security of citizens before state institutions. Therefore, the whole country should have inclusive reforms in judicial power and prosecution as a precondition for restoring citizensВ’ trust, institutions that will guarantee that the executive and legislative power do their functions in accordance to legal acts and international standards. The results of this paper should reflect the analysis of the functioning of the justice system, the flaws and recommendations to improve justice institutions. The used methodology will be in the function of researching the subject and obtaining results and conclusions of the work using appropriate legal and sociological scientific methods that will achieve the specified objective. Part of the paper will be the conclusions of the paper that will be the product of analysis and scientific research.
