LEGALIZATION OF THE GAMBLING BUSINESS IN FOREIGN COUNTRIES: PROS AND CONS, PROBLEMS AND PROSPECTS OF REGULATION
Abstract
In the modern world the question of the need for the legalization of gambling business is debatable, numerous disputes over this issue continue to date. At the same time supporters of both points of view adduce serious arguments in justification of their positions. Proponents of the legalization claim that permission of lawfully operating gambling industry will promote inflow of the considerable money to the budget necessary for development of various spheres of public administration, activization of the tourist industry, and also to rapid "underground" development of a gambling business. However opponents of the legalization are convinced that it will lead not only to mass violations of mental health, the caused dependence on gamblings, but also to moral falling, spiritual crisis and degradation not only adult population, but also youth and children – the national future of any country. In justification of relevance of the problem there are numerous examples in the article of how many states have to balance between punitive measures and commercial interest that in turn generates shortcomings of regulation of this sphere. The exit from this problem is consisting in partial legalization of gambling business. At the same time, it is proposed to organize in each state the specific territory - "gambling zones" or specialized institutions where this activity will be allowed. The main purpose in this case is to delimit access to gambling for broad masses. As a result of the analysis of the law enforcement agencies' experience in European countries about fighting against illegal gambling activity the important direction of the proposed policy is also considered an activation of new control authorities and supervision over the activities of gambling which powers will be expanded, divided between various divisions and strictly unified. In addition, the prevention of illegal gambling seems effective at involvement of the active population which will render assistance to the authorities, and also at improvement of the legal basis in this sphere. It is supposed that the welfare of not only the certain countries, but also the safety and welfare of all world community depends on the effectiveness of the implementation of the proposed measures and the prospects for further development of the regulation of the gambling industry.
