LEGAL FEATURES OF THE CONSTITUTIONAL CRISIS IN THE CONTEXT OF THE ARMENIAN REVOLUTION
Abstract
Topicality. The 14th of January, 2019, the day of the commencement of authority of the 7th convocation of the National Assembly of the Republic of Armenia, which draws up the completion of the constitutional crisis and the Velvet Revolution in Armenia, which began in April 2018. The report is focused on the legal features of the constitutional crisis in this context that remains still unknown in this aspect. Aim: to disclose the most significant legal features of the constitutional crisis in the context of the Armenian Revolution. Hypothesis: The constitutional crisis, which was the legal expression of the Armenian Revolution, had as its legal features the constitutional reform initiated in 2013 by President Serzh Sargsyan. The essence of this constitutional reform was the transformation of the form of government in Armenia from a semi-presidential to a parliamentary republic. Upon the completion of the stateВ’s transition to a parliamentary form of government, the constitutional crisis was formed in the country due to the socio-political background and legal defects of the Constitution. Discussion: Generally, constitutional crisis occurs with the use of violence, violation of the Constitution and other laws of the country, human rights abuses and concludes with an illegal change of the constitutional order, which exerts its destructive influence on the future development of the state. At the same time, the constitutional crisis in Armenia, presenting the legal structure of the Armenian Revolution, at each stage of its progress is characterized by the nonviolent actions, nationwide support of the new government and strict compliance to the existing legislation, which is expressed in legal facts described in the report. Method: The method of analysis and synthesis and the method of interpretation of legal norms. Results: The constitutional crisis is the constitutional expression of the Armenian Revolution. The report identifies three stages of the constitutional crisis, each of which has its own legal features. The author comes to the conclusion that the constitutional crisis developed and was resolved exceptionally according to the statutory Constitution.
