ORGANIZATIONAL AND LEGAL BASIS FOR PREVENT FRAUD USING ELECTRONIC MEANS OF PAYMENT
Abstract
The tendency to increase the volume of Bank transactions and losses from theft committed using electronic means of payment indicates the need to ensure the security of non-cash transactions. The article presents the basics of the modern concept of fraud prevention using electronic means of payment, formulated on the basis of studying the experience of foreign countries, current trends, and prospects in the field of non-cash Bank transfers. For the purpose of writing the article, the authors used foreign and Russian legislation in the field of transactions using electronic means of payment. In the course of the paper, general scientific, specific scientific and systemic methods of cognition were used, namely, the statistical method, formal legal and comparative legal methods of cognition, modeling, comparative legal, systemic and structural, as well as content analysis of Russian and foreign laws, which allowed summarize the collected information and formulate proposals and conclusions on the research topic. The concept of В«electronic means of paymentВ» covers bank cards, contactless payment systems, for example, near field communication (NFC) electronic wallets, electronic data carriers, as well as other technical devices for generating transactions, which determines its application in this article. Therefore, within the framework of the article, non-cash transfers of this group are studied. Russian criminal law identifies various forms of theft, such as theft, fraud, and others. For the purpose of a uniform understanding of the content of our research, fraud by using electronic means of payment is understood as the unlawful use of a bankcard, electronic wallet, or other electronic means of payment for the purpose of making an unauthorized purchase.
