WORK CONFLICTS AND THE ROLE OF THE MEDIATION IN THE RESOLUTE THEM

Abstract

The present paper analyzes the most important Romanian Work conflicts in concordance with the law 53/2006 utilizing the mediation law 192/2006. Faced with these litigations we have the advantage of the mediation because we have the possibility to resolve the conflicts in a short time, to transform a bad situation in a new opportunity and to find solutions for long term. Why do we use this tool when we have a conflict in the work place? - We have the possibility to transfer to the person involved in the conflict the way in which we are affected by these actions and also the way to resolute the situation. - This discussion with the other part is made in a protected, confidential and balanced place. - We can demand separated sessions if we are affronted or if we don't want to have a direct discussion. - Our needs and the interests are protected by a specialist in mediation. - We also have the possibility to get a lawyer with the task to protect our rights. - The mediation sessions are in our timetable. - The mediation has a neutral location which is the mediator's office. - We have the possibility to take finally our own right decision. - The resolution can be done in a short time, not in long sessions. - We have the right to protect some information.
