VALIDITY OF THE STAGE OF CRIMINAL CASE INITIATION FOR RUSSIAN CRIMINAL TRIAL
Abstract
The issue of the legal future of the institution of criminal case initiation and its significance for Russian law enforcement practice is studied in the article. The author analyses the arguments of the scholars and practitioners, who on the basis of foreign experience of regulating the initial stage of pre-trial proceedings, put forward the idea of abolishing the initial step of the procedure and propose to make full preliminary investigation from the moment of receiving the initial information about the crime. The article provides theoretical and statistical justification for the maintenance in the Russian criminal procedure of the proceedings for investigating the presence or absence of legal and factual grounds for the commencement of criminal prosecution of a person suspected of committing a crime, regardless of the criminal procedure order adopted in future by the Russian legislation.
