TRANSFORMATION OF THE APPROACHES TO THE SOLUTION OF THE PROBLEM OF PROVIDING RELIGIOUS RIGHTS IN THE EDUCATIONAL PROCESS (BY THE EXAMPLE OF RIGHTS TO WEAR RELIGIOUS CLOTHES AND/OR ATTRIBUTES)

Abstract

Religious rights and controversial approach to their provision and implementation will always be in the centre of discussions in all states including multiconfessional Russia. One of the points is connected with educational process. The most contradictory issues are talking about Muslim religion: on the one hand, there are multiple examples from judicial practice where the right of Muslim women to dress in accordance with their religious commitments meets no protection, on the other hand, there is the permission to have passport pictures taken with hair wear but not covered ears and forehead. One of the most interesting examples is protection of rights of Muslim students to dress in accordance with their religious commitments in secular educational institutions. Here we can see ambiguousness in the approaches of the decisions of courts of justice. Most examples of the judicial practice are connected with failure to present the protection of these rights. First of all, it is the decisions of the Supreme Court of the Russian Federation dated July 10, 2013 and February 11, 2015 when the court of Russia legitimated the prohibition to demonstrate religious attributes and wear religious scarfs in schools. The authors of the article are trying to discover transformations of the right for freedom of faith in the modern Russian society while showing the results of authentic Mari State University public opinion.
