PROBLEMS OF PARTICIPATION OF THE STATE BORDER GUARD SERVICE OF UKRAINE AS A PLAINTIFF IN ADMINISTRATIVE CASES REGARDING THE PERSONS WHO VIOLATED THE LAW OF UKRAINE ON THE STATE BORDER
Abstract
In the mentioned scientific article, on the basis of the current administrative procedural legislation, judicial practice and legal doctrine, author has conducted a scientific study of the peculiarities of solving cases involving the State Border Guard Service of Ukraine as a plaintiff in administrative cases concerning persons who violated the legislation of Ukraine about the state border. There are determined main grounds for refusal to satisfy an administrative claim of the body of the State Border Guard Service of Ukraine on the forced expulsion of foreigners and stateless persons or about their detention and problems, which arising in law enforcement activities. In particular, law enforcement has a number of problems in cases involving the State Border Guard Service of Ukraine as a plaintiff on issues of forced expulsion of foreigners and stateless persons beyond Ukraine or on issues of their detention until a decision on the recognition of their refugees or persons who need additional protection in Ukraine or in order to ensure their transfers in accordance with the international agreements of Ukraine on readmission, or on the extension of the term of detention of foreigners or stateless persons with a view to their identification and / or enforcement of forced expulsion out at the state borders of Ukraine. One of these problems is the question of the identification of a foreigner, therefore the bodies of the State Border Guard Service of Ukraine have to file a statement of administrative suit claim to the court on: the extension of the detention period of a foreigner or stateless person, including in connection with the lack of information from the country of civic the identity of the foreigner or the country of origin of the stateless person or the documents necessary for identification of the person, the lack of cooperation of the foreigner or stateless person during the procedure of his identification.
