FORMS OF PARTICIPATION OF COMMUNE RESIDENTS IN MAKING DECISIONS ON LOCAL MATTERS

Abstract

The paper is devoted to the issues of forms of participation of commune residents in making decisions on matters concerning their local self-government community. The analysis included legal solutions guaranteeing members of self-government communities participation in the process of establishing local law and its application. The regulations in force determine the forms of participation of commune residents in making decisions. The characteristics of these forms were preceded by their classification allowing for the distinction of: forms of direct and indirect participation in the legislative procedure, or in proceedings in individual cases relevant to a given community; forms requiring collective action and initiated by the individual. The main goal of the study is to formulate a catalogue of representative forms, taking into account the aforementioned typology, guaranteeing the residents of the basic local government unit participation in making decisions in public matters. The reflections taken up serve to justify the thesis that tools of participation made available to the members of a self-government community allowed them to have a real impact on matters crucial to this community. At the same time, an attempt was made to answer the question whether the catalogue of these forms should be considered as complete or whether there are any premises justifying supplementing it. In the conducted deliberations, a method of analyzing the normative material, researching the acquis of the doctrine of administrative law and judicature was used.
