INTERNATIONAL TRANSFERS OF PERSONAL DATA
Abstract
In the article authors review rules applicable to international transfers of personal data. With the adoption of the General Data Protection Regulation (GDPR) in the European Union (EU), substantial requirements were introduced by the co-legislators to ensure organisational and technical safeguards of any data processing of EU citizens. These safeguards are crucial to ensure adequate protection of citizensВ’ rights, especially in case of international transfers to the countries outside of the European Union or to international organisations. In addition, the authors drew their attention to the practical implementation of the rules on international transfers of personal data. With the high level of awareness of the data protection rules, there is not enough understanding about the operationalisation of rules. Small businesses sometimes struggle to provide sufficient resources to comply with the high standards for the protection of personal data introduced by the GDPR. Nevertheless, the objective of the GDPR is not to impose additional burdens to businesses, but to ensure the free flow of personal data within the EU and to protect fundamental rights and freedoms of citizens
