CRIMINAL PROCEDURAL FORM AND ITS DIFFERENTIATION
Abstract
The main objective of habitat is the rationale for and feasibility of differentiating the criminal process from the viewpoint of science and from the standpoint of an applied nature and studies its impact on the efficiency of the process. The article analyzes the theoretical principles of differentiation and investigates features of both complicated and simplified criminal procedure forms. At present the structure of the criminal procedure is complicated, which is determined by the diversityof forms of criminal procedural activities. Criminal procedures could be divided into those conducted as general procedure, simplified ones as well as special procedure. Considering internal and external content features of criminal procedural forms, general criminal procedure must be considered as the main form of the criminal procedure. As a result of differentiation, other forms must be viewed as sub-types of the above one, which have acquired an independent form in the criminal procedure. If the system is not constructed in such a way, shortcomings can hardly be observed in the bases (principles) of organization of criminal procedural forms because the unified criminal procedure order is overall ensured.
