LEGAL FUNDAMENTALS OF VOLUNTEER ACTIVITY
Abstract
The study is devoted to the analysis of legal regulation of volunteer activity, and to the formulation of suggestions on the improvement of Russian legislation in the sphere of volunteer activity.Carrying out of the research is based on international, foreign and domestic sources of a normative and recommended character.The research was conducted on the basis of an integrated approach and the principle of methodological pluralism.The international level of legislation is represented in the study by the U.N.O., International Red Cross and International Association for Volunteer Effort documents.The analysis of foreign countries legislation on volunteer activity includes both special laws on volunteer activity (the laws of Portugal, Italy, Czechia, Poland, and others) and the laws on charitable activity (the laws of Lithuania, Great Britain, and others).The study of the Russian Federation legislation covers both the federal and the regional levels (legislation of Moscow, St. Petersburg, and others).The study gives the list of volunteer programs, most widely-spread in Russia and foreign countries.Alongside with volunteer activity the research is done on other forms of socially useful activity of persons (missionary work, donorship, patronage, alternative civil service and others).In conclusion of the study: 1. the principles of volunteer activity are pointed out and its definition is formulated; 2. the conclusion is drawn about the necessity of legislative differentiation of the volunteer and other forms of socially useful activity taking into account the different criteria; 3. changes in Russian legislation concerning guarantees of volunteer activity (recovery of expenses of volunteers on voluntary insurance) are suggested. The results obtained in the course of research are applicable in the field of legal and political sciences, as well as in the spheres of state administration and education.
