Abstract

The progressive process of erosion of the European institutional structure, which took place starting from the economic crisis up to the crisis resulting from Brexit, requires careful reflection on the process of European integration, in its historical, political and social conditions. The research work conducted by the jurist Joseph Weiler, allows to draw a clear appearance of constitutive aspects of the European Community. Adopting an interdisciplinary approach, which includes law, economic, political, social and historical sciences, the Author offers an organic synthesis of the origin and directionality proper to the process of European integration. Through the method called total low, the European Union defines itself through the multiformity of the aspects that compose it. The present work will propose an analytical synthesis of the most relevant aspects of the Community construction as proposed by the works of Joseph Weiler. By focusing on the identity of the European Union, the ideals laid at the foundation of its institution will emerge as the key to resolving the present process of political and social disintegration. Finally, the legal approach will reveal a spectrum through which all political, social, cultural and historical aspects are expressed in a reciprocal dialogue. Constitutional tolerance becomes the juridico-political synthesis of the social and cultural identity of the European Union, through which it is possible to redefine the reciprocal relations between States and to decline the interest in the common good in a community perspective.
