LEGAL REGULATION OF NON-GOVERNMENT ORGANIZATIONS FUNDING

Abstract

This article deals with the modern mechanisms of the non-profit organizations funding and its legal regulation. The matter is that today such organizations play a growing role in building civil society, social dialogue and participatory democracy. But they may be effective if only they are effective in fundraising. NGOs rely on money from a variety of sources, including donations, loans, sponsorships, incomes from entrepreneurial activity and public subsidies. It seems that there are many sources of funding, but financial problems are still the most serious obstacle to their activities. The special attention in this research is paid to public funds and its legal regulation. It helps non-profit organizations achieve their missions. At the same time, it requires the appropriate legal regulation based on such principles as rule of law, equality, the transparency of its budgeting and reasonableness of state subsidies. Although any national legislation has its specific features it should be based on such general legal principles to guarantee the independency on non – government organizations in their decision making. At the same time, law rules shall be clear and simple to avoid the artificial administrative barriers for non-profit organizations’ activity. The author relied on such methods as analysis, synthesis, deduction, dialectic methods as well as on legal-comparative analysis.
