THE ROLE AND THE IMPORTANCE OF LEGISLATIVE DELEGATION IN ALL CONSTITUTIONAL NORMS
Abstract
Currently, the imminence of the primary regulation of social relations in very varied fields makes it almost impossible for Parliament to intervene timely, which makes use of legislative delegation. Thus, not only the inefficiency, but also the inopportunity of Parliament's legislative activity are among the arguments put forward to empower the Government to issue ordinances, through which Parliament tries to transfer part of its responsibility to social issues to the Government. Legislative delegation is a living manifestation of the relations between the two major powers of the state, respectively, between the legislative and the executive powers. The implications of this special legislative-executive report are varied, expressly captured in the constitutional text, intended to further ensure, along with the judiciary, what doctrinaires call constitutional democracy. The purpose of the paper is to complexly investigate the theoretical and practical aspects of legislative delegation, starting from the analysis of this concept, While studying the causes of this notion's dimension, but also identifying the content of the legislative delegation institution in the current legislative context.
