LEGISLATIVE REGULATION OF FINANCIAL CONTROL (SUPERVISION AND AUDIT) AS AN STATE DEMOCRATIZATION INDICATOR
Abstract
The authors suggest that the development of civil society as well as of information technologies are objective factors that influence the content of the legislation of any modern state. From this perspective, they evaluate the system of financial control (supervision, audit) in the Russian Federation and the quality of its legal regulation. To determine the specifics of the legislative regulation of financial control, a comparative legal analysis of regulatory legal acts of the Russian Federation and of a number of foreign states was carried out, as well as analysis of scientific sources; network analysis of the activity of using Internet resources devoted to financial control and a survey of participants in public discussion of the report on the budget execution of the subject of Russia (Krasnodar region) allowed to assess the opinions of citizens and officials on the relevant legislation. The authors define some new types of financial control (supervision, audit) emerged in the period of building the democratic foundations of the Russian state and determined by the development of information technologies. Thus, public financial control, state and municipal procurement control, state external audit, efficiency audit, control over the use of cash registers, supervision in the national payment system, etc. are developing in Russia. The high quality of legislative regulation of financial and control relations raises the level of public confidence towards state institutions, which is important for the Russian Federation. The surveys of citizens and officials showed that the possibility of enactment the federal law "On the Fundamentals of Financial Control" is considered by them positively (90% of those spoke in favor of adopting such a law). As a result of the study, the authors concluded that the system of financial control (supervision, audit) in modern states is consistently expanding under the influence of the institutions of civil society and achievements of scientific and technological progress. The authors believe that the legislative unification of the principles, forms, methods of financial control not only reduce the risk of legal errors but also increase the level of public confidence towards the state, presenting a proof of its democratization. According to the authors the best form of establishing general rules of financial control is the law.
