PROBLEMS OF IMPLEMENTATION OF THE PRINCIPLES OF THE FEDERAL STRUCTURE OF THE RUSSIAN FEDERATION
Abstract
Analysis of the problems of the federal structure and new trends in its development are particular importance for Russia. Since the collapse of the USSR, the country has passed a difficult and long way of becoming from Soviet federalism to the modern democratic Federation. This transformation took place against the backdrop of complex and controversial political and socio-economic relations, as well as various crises that encompassed all aspects of social life. The basic principles, fundamental ideas characterizing the model and nature of the federal structure are enshrined in the Constitution of the Russian Federation. These include: state sovereignty, the unity of state power, equal rights of subjects, the constitutional delineation of subjects of competence and powers between the Federation and the subjects, equality and self-determination of peoples. This article highlights a number of features of modern Russian federalism, which give it uniqueness, since by many criteria there are no analogues in international practice. It is noted that currently the implementation of the principles of a federative state is difficult in practice, which indicates the imperfection of the constitutional model, which requires a search for new theoretical approaches to rethinking the content and system of principles of the federal structure. In conducting the study, the authors used general scientific methods of analysis, which include: system, statistical and comparative legal approaches - as well as general logical methods of cognition: analysis, synthesis, induction, deduction. The theoretical and empirical basis of the work was the scientific works of Russian and foreign scientists. Regulatory and sociological materials were used as an information base for the study. As a result, the authors came to the conclusion that the solution of existing problems must be sought in strict adherence to constitutional principles, which in their essence should become a vector in reforming and improving the state structure of Russia. This should also be supplemented by the obligatory necessity of the functioning of all subjects as a whole, which in turn should be promoted by regional and local social communities seeking to preserve and strengthen the unity and territorial integrity of the state.
